Agreement to Receive Text Messages

By providing your mobile telephone number and affirmatively opting into any School Enrollment Group or Higher Secondary Consultants LLC (“School Enrollment Group,” “Company,” “we,” “our,” or “us”) text messaging program, you expressly consent to receive recurring automated marketing, promotional, informational, transactional, customer service, account-related, and operational text messages at the mobile telephone number you provide.

Messages may be sent using an automatic telephone dialing system, automated technology, artificial intelligence-enabled messaging systems, prerecorded technology where permitted by law, or other messaging technologies authorized under applicable law.

Your consent to receive text messages is voluntary and is not a condition of purchasing any products or services from School Enrollment Group.

By enrolling in a messaging program, you certify that you are the authorized subscriber or customary user of the mobile telephone number provided and that you have authority to consent to receiving messages at that number.

Program Description

School Enrollment Group may use text messaging programs to provide:

  • Responses to inquiries

  • Consultation scheduling

  • Appointment reminders

  • Enrollment marketing information

  • Educational marketing updates

  • Customer support communications

  • Account notifications

  • Service updates

  • Promotional offers

  • Newsletters

  • Event invitations

  • Surveys

  • Business communications

  • Other information relating to the services offered by School Enrollment Group

The content, timing, and frequency of messages may vary based on your interactions with us, submitted inquiries, service requests, account activity, participation in promotions, customer service interactions, and other factors.

Message Frequency

Message frequency varies. The number of messages you receive depends upon your interactions with School Enrollment Group, your inquiry activity, consultation requests, service engagements, account activity, and participation in messaging programs.

School Enrollment Group does not guarantee any minimum or maximum number of messages.

Message and Data Rates

Message and data rates may apply to messages sent or received through our messaging programs.

Charges are determined solely by your wireless carrier and mobile service plan. School Enrollment Group is not responsible for any charges, fees, taxes, or surcharges imposed by your wireless carrier.

Opt-Out Instructions

You may opt out of receiving marketing and promotional text messages at any time by replying STOP to any text message received from School Enrollment Group.

Upon receipt of your STOP request, we may send a one-time confirmation message verifying that your opt-out request has been processed. Following confirmation, you will no longer receive marketing or promotional text messages unless you subsequently provide new consent.

Additional opt-out commands that may be recognized include:

  • CANCEL

  • END

  • QUIT

  • UNSUBSCRIBE

  • STOPALL

  • STOP ALL

Please note that opting out of marketing messages does not prevent School Enrollment Group from sending transactional, account-related, customer service, legal, security, fraud prevention, appointment-related, or other communications permitted by applicable law.

Supported Carriers

Messaging services may not be available on all wireless carriers, devices, operating systems, or geographic locations.

Participating carriers may change without notice. Carrier participation does not constitute endorsement of any messaging program offered by School Enrollment Group.

Wireless Carrier Disclaimer

Wireless carriers are not liable for delayed, failed, incomplete, misdirected, corrupted, filtered, or undelivered messages.

Delivery of text messages is subject to effective transmission by your wireless service provider and network availability. School Enrollment Group does not guarantee message delivery and shall not be responsible for delays caused by:

  • Carrier restrictions

  • Network outages

  • Technical failures

  • Filtering mechanisms

  • Equipment malfunctions

  • Circumstances beyond our reasonable control

Changes to Mobile Telephone Numbers

If your mobile telephone number changes, you agree to promptly notify us and, where necessary, re-enroll in our messaging programs using your new mobile telephone number.

You acknowledge that failure to update your mobile telephone number may result in messages being delivered to an unintended recipient, and you agree that School Enrollment Group shall not be responsible for damages arising from such circumstances.

Consent Records and Compliance Documentation

To comply with applicable federal and state laws, carrier requirements, telecommunications regulations, industry standards, and fraud prevention obligations, School Enrollment Group may maintain records relating to your consent and participation in messaging programs.

Such records may include:

  • Mobile telephone number

  • Date and time of consent

  • IP address

  • User agent

  • Device information

  • Source URL

  • Landing page information

  • Account information

  • Inquiry information

  • Opt-in language presented

  • Session activity

  • Consent logs

  • SMS interactions

  • Related compliance records

These records may be retained for as long as reasonably necessary to comply with legal obligations, establish consent, defend claims, prevent fraud, and protect our rights.

Privacy and Data Usage

Information collected through our messaging programs is governed by the School Enrollment Group Privacy Policy.

By participating in any messaging program, you acknowledge that your information may be collected, processed, stored, disclosed, and used in accordance with the Privacy Policy.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be shared with subcontractors, vendors, service providers, platform providers, customer service providers, cloud hosting providers, analytics providers, and SMS delivery providers solely to support business operations and messaging services.

Text messaging originator opt-in data, consent records, and mobile phone numbers collected for messaging purposes will not be sold, rented, leased, transferred, disclosed, or otherwise shared with any third party for its own marketing or promotional purposes.

Suspension, Modification, and Termination

School Enrollment Group reserves the right to modify, suspend, restrict, discontinue, or terminate any messaging program, in whole or in part, at any time and without prior notice.

We reserve the right to modify the following at our sole discretion:

  • Message content

  • Delivery methods

  • Supported programs

  • Participating carriers

  • Enrollment procedures

  • Eligibility requirements

  • Technical specifications

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL MESSAGING PROGRAMS ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

SCHOOL ENROLLMENT GROUP DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR UNINTERRUPTED OPERATION.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOL ENROLLMENT GROUP, HIGHER SECONDARY CONSULTANTS LLC, AND THEIR RESPECTIVE AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO ANY MESSAGING PROGRAM.

THIS LIMITATION INCLUDES DAMAGES ARISING FROM DELAYED, FAILED, INCOMPLETE, MISDIRECTED, CORRUPTED, FILTERED, OR UNDELIVERED MESSAGES, NETWORK FAILURES, SERVICE INTERRUPTIONS, DATA LOSS, OR CARRIER ERRORS.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF SCHOOL ENROLLMENT GROUP EXCEED ONE HUNDRED DOLLARS ($100.00).

Indemnification

You agree to defend, indemnify, and hold harmless School Enrollment Group, Higher Secondary Consultants LLC, and their affiliates, members, managers, officers, employees, contractors, agents, successors, assigns, and service providers from and against any claims, damages, liabilities, losses, costs, expenses, penalties, fines, and attorneys’ fees arising out of:

  • Your participation in any messaging program

  • Your violation of these Mobile Messaging Terms

  • Your violation of applicable law

  • Your misuse of any messaging service

Governing Law

These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Wyoming without regard to conflict-of-law principles.

Dispute Resolution

To the fullest extent permitted by law, any dispute arising out of or relating to these Mobile Messaging Terms or any messaging program shall be governed by the arbitration, class action waiver, governing law, and dispute resolution provisions contained in the School Enrollment Group Terms of Service, which are incorporated herein by reference.

Changes to These Terms

School Enrollment Group reserves the right to modify these Mobile Messaging Terms at any time.

Updated versions shall become effective immediately upon posting. Continued participation in a messaging program following publication of revised terms constitutes acceptance of such revisions.
